Privacy Policy

This Privacy Policy (“Policy”) is between Grace and Grit Interiors (“Company”) and any individual who uses, accesses, and/or interacts electronically with the Company (“User”), including, but not limited to, websites, social media pages, and/or online services (“Platforms”). This Policy governs data collection and usage. By using any of the Company’s Platforms, the User consents to the data practices and collection methods described herein.

1. Collection of Personal Information

The Company does not collect any personal information from Users unless they voluntarily provide it. However, Users may be required to provide certain personal information when electing to use certain products or services. This information may include, but is not limited to:

• i. Registering for an account;
• ii. Entering a sweepstakes or contest sponsored by the Company or one of its partners;
• iii. Signing up for special offers from selected third parties;
• iv. Sending the Company an email message; and/or
• v. Submitting User’s credit card and/or other payment information when ordering and purchasing products and services from the Company.

The Company will use User information for, but not limited to, the following purposes: communicating with Users in relation to services and/or products requested from the Company and other reasons as set forth in this Policy. The Company may also gather additional personal or non-personal information in the future.

2. Use of Personal Information

The Company collects and uses User personal information in the following ways, including but not limited to:

• i. To operate and deliver User-requested services;
• ii. To provide Users with information, products, or services requested from the Company;
• iii. To provide Users with notices about their accounts;
• iv. To perform the Company’s obligations and enforce its rights arising from any contracts between the User and the Company, including for billing and tax purposes;
• v. To inform Users of other products or services available from the Company and/or its affiliates; and
• vi. For any other purpose consented to by the User.

3. Sharing Information with Third Parties

The Company does not sell, rent, or lease its customer lists to third parties.

The Company may, from time to time, contact Users on behalf of external business partners about a particular offering that may be of interest. In such cases, Users’ identifiable information (name, email address, phone number) is transferred to a trusted third party. The Company may share data with trusted partners to help perform statistical analysis, send Users email or postal mail, provide User support, and/or arrange for deliveries. All such third parties are prohibited from using User’s personal information except to provide these services to the Company, and they are required to maintain the confidentiality of User information.

The Company may disclose User’s personal information to the following individuals and entities, for the following purposes:

• i. To share User information with customer relationship management, consultants, financial, legal, and other similar providers to support the Company;
• ii. To software/IT service providers supporting the Company who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which the Company discloses it;
• iii. To banks and credit card processors to the extent necessary for the Company to provide and deliver its products;
• iv. When the Company, in its sound discretion, believes sharing is necessary to protect its rights, preserve safety, and/or investigate fraud or other wrongdoing;
• v. When required by law, including complying with any court order, law, or legal process, including responding to a government or regulatory request;
• vi. In connection with the sale, transfer, or financing of the Company’s business or its assets, including a bankruptcy proceeding or to the Company’s affiliates;
• vii. To enforce or apply Company agreements, including for billing or collection purposes;
• viii. For any other purpose the Company disclosed to Users when providing information.

In this Policy, “sharing” means disclosing personal information to third parties for the purposes of:

i. Service Providers – Sharing User personal information with contractors, freelancers, and/or additional third-party service providers who assist in delivering the interior design services, including but not limited to photographers, contractors, and delivery services.

ii. Payment Processing – Sharing information with payment processors to facilitate transactions for services rendered.

iii. Legal Obligations – Disclosing information as required by law, such as complying with subpoenas or other legal processes.

iv. Business Transfers – Sharing information in the event of a merger, acquisition, or other sale of assets where customer information would ordinarily be transferred as part of the transaction.

v. Consent – Sharing information with third parties when the User has given explicit consent.

vi. Marketing and Promotions – Sharing information with third-party marketing partners or advertisers if the User has opted into receiving marketing communications.

vii. Security and Protection – Sharing information to protect the rights, property, or safety of the business, Users, customers, or others.

4. Cookies and Tracking Technologies

i. Cookies – The Company’s websites may use “cookies” and other tracking technologies to gather information about User interactions. This information may include demographic data, browser type, IP address, pages visited, activities conducted on the page, and the day and time of User’s visit. The Company’s websites may use both session cookies (which expire once Users close their web browsers) and persistent cookies (which stay on User computers until they are deleted). Users should refer to their computer browser help instructions for more information on cookies and how to manage them. If Users refuse or delete cookies, some of the website’s functionality may be impaired.

ii. Web Beacons – Pages of the Company’s websites may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that allow the Company to count users who have visited those pages. The Company may use this information to improve the website experience for Users and tailor marketing communications.

5. Opt-Out of Disclosure of Personal Information to Third Parties

The Company respects User privacy and gives Users an opportunity to opt out of receiving announcements of certain information. Users may opt out of receiving any or all communications from the Company’s third-party partners by contacting:

Users have the right to opt out of their personal information being processed:

i. For targeted advertising;
ii. For the sale of personal information; or
iii. For profiling to make automated decisions that produce legal or similarly significant effects.

The Company processes personal information for targeted advertising and sells personal information. However, the Company does not use personal information for profiling to make legally significant decisions.

6. Changes to the Policy

The Company reserves the right to change this Policy at its sole discretion. Changes may occur due to updates in services, data protection practices, and/or changes in the law. The Company will prompt Users to agree to a new Policy every time there is a change. User’s continued use of the website and/or other services provided by the Company will constitute:

1. An acknowledgment of the new Policy, and
2. An agreement to abide and be bound by the new Policy.
